Meyers Fried-Grodin Case Selected for Review by New York Court of Appeals

On June 30, 2015, the New York State Court of Appeals granted leave to hear a matter being handled by Meyers Fried-Grodin LLP.  The case is Charite et al v. Duane Reade, Inc. et al., 2015 NY Slip Op 77726 (N.Y. 2015).  It involves the New York whistleblower statute (New York Labor Law section 740) and the New York City Human Rights Law.  Issues before the Court include the scope of the whistleblower statute's election of remedies effects (and whether its "waiver" provision trumps the important remedial purpose of allowing claims to proceed under the New York Human Rights Law).  The Court of Appeals is the highest Court in the state of New York (simlar to the U.S. Supreme Court, but on the state, instead of federal level).  The Court only chooses a few cases to hear each year.  Follow the link to see the decision:
